Shouldn't Malcom have know not necessarily hes dead but something was wrong? The plot takes place several months to a year after hes shot, so who assigned him to cole? How did he not realize he stopped getting pay checks, in the scene where hes sitting across from coles mom we know she didn't let him him, did he let himself in and sit across from this woman in her own house without trying to say two words to her?
