The Eagles weren't Gandalf's magic, though they would count as a "typical fantasy race" in your first point. On the other hand, Game of Thrones has magical possession, and possibly shapeshifting people, so I think it's a wash :)

IMO, Game of Thrones has more overt magic in it than Lord of the Rings does; Tolkein's magic was very understated and secondary to the story. Gandalf was forbidden to use his magic to "save the day" -- he only really uses it against bigger magical foes. Compare to, e.g. using magic to assassinate people.

I'm pretty sure they were with the US at least in Vietnam becase that's where Stryker found them and he was a US officer; after that I just went with the simplest answer.
